Terms of Service

1. Accepting these Terms

By creating an account or using CUB Line ("the Services"), you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Description of the Services

CUB Suite provides tools built specifically for regulated health practitioners in British Columbia. CUB Suite is not a clinical records system, electronic health record, or charting platform.

CUB Line is a dedicated clinic phone line, enabling SMS messaging and voice calls through a dedicated local BC phone number, so practitioners can communicate with patients without sharing their personal number.

3. Eligibility

CUB Suite is intended for regulated health professionals operating in British Columbia. By using CUB Line, you confirm that you are a licensed or regulated health practitioner and that you will use the service in compliance with your professional obligations and applicable Canadian privacy law.

4. Your responsibilities for patient information

You are the organization responsible for your patients' personal information under BC PIPA. By using CUB Line, you agree to:

  1. Tell your patients that you use CUB Line to communicate with them, and obtain their consent as required by law and your regulatory college.

  2. Stop messaging any patient who opts out. Texts to a number that has replied STOP are blocked automatically.

  3. Keep any records your regulatory college requires. CUB is a communication tool, not your record-keeping system. Export anything you need to keep before deleting conversations or cancelling.

  4. Respond to patient requests to access, correct or delete their information. CUB provides tools to help.

  5. Use CUB Line in line with your college's standards for electronic communication.

5. CUB as your service provider

When CUB handles your patients' information, we act on your behalf. We will:

  1. Use patient information only to provide CUB Line to you, and never sell it or use it for marketing.

  2. Protect it with reasonable security safeguards, as described in our Privacy Policy.

  3. Limit access by CUB staff to what is needed for support, fixing problems, or meeting legal requirements.

  4. Use only the service providers listed in our Privacy Policy, and update that list before adding a new provider that handles patient information.

  5. Notify you without unreasonable delay if we learn of a breach affecting your patients' information, and help you meet your own notification obligations.

  6. Help you respond to patient requests to access, correct or delete their information.

  7. When you cancel, keep your data for a reasonable period so you can export it, then delete it, except where we must keep it by law.

6. Subscription and billing: CUB Line

CUB Line subscriptions are billed monthly through Stripe. You may cancel at any time; cancellation takes effect at the end of your current billing period. The Founding 50 rate is locked in for the lifetime of your subscription as long as it remains active and in good standing. CUB Suite reserves the right to change pricing for new subscribers at any time.

7. Your clinic number

Your dedicated clinic number is provisioned through Twilio and remains active as long as your CUB Line subscription is active. If your subscription lapses beyond the grace period, your number may be released and reassigned. CUB Suite is not liable for any consequences resulting from loss of a phone number due to subscription cancellation or non-payment.

8. Refunds

CUB Line: subscription payments are non-refundable, but you may cancel at any time to stop future billing.

9. Acceptable use

You agree to use CUB Suite only for lawful professional purposes consistent with your regulatory and ethical obligations, and not for spam, harassment, unauthorized resale, or any communication or use that violates Canadian law.

Permitted use: CUB Line. Professional communication between health practitioners and patients in British Columbia, by SMS and voice, consistent with your regulatory and ethical obligations. This includes messages you send to several patients at once and automatic replies you set up, such as Off Duty messages, when sent to patients who have consented and have not opted out.

Prohibited use: CUB Line.

  • Sending unsolicited messages (spam) of any kind

  • Bulk messages or marketing sent to people who have not consented to hear from you

  • Any communication that violates Canada's Anti-Spam Legislation (CASL)

  • Using CUB Line for any illegal purpose

  • Harassment, abuse, or threatening communication

  • Reselling, sharing, or transferring your clinic number to another person

Fair use: CUB Line. While CUB Line offers unlimited SMS messaging, this is intended for normal clinical communication volumes. We reserve the right to investigate and suspend accounts showing unusual messaging patterns that suggest misuse or automated sending.

Not for urgent care or emergencies. CUB Line is not monitored around the clock. Tell your patients how quickly you typically respond, and how to reach you or emergency services in urgent situations. CUB Line uses VoIP technology provided by Twilio and is not intended for emergency use. Attempting to contact 911 or other emergency services through your CUB clinic number results in an emergency calling fee from our telephony provider. CUB passes this on to the account holder as a charge of $150 CAD, which includes currency conversion. Always use a traditional phone line or mobile device to contact emergency services. Patients should always have independent access to emergency services (911) and crisis lines.

CUB clinic numbers are VoIP numbers and may not be accepted for SMS-based two-factor authentication, such as by banks or government services.

10. Privacy

11. Disclaimer of warranties

CUB Suite is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, and we are not liable for any loss of data, missed communications, or disruption to your practice.

12. Limitation of liability

To the maximum extent permitted by Canadian law, CUB Suite's total liability to you for any claim arising from use of the Services shall not exceed the amount you paid in the three months preceding the claim.

13. Governing law

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.

14. Changes to these Terms

We may update these Terms from time to time. We will post updates here with a new version number and date, and notify active users of material changes by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
